Farm Mediation
Iowa law identifies various sectors relevant to rural mediation, such as farmer-creditor affairs, farm nuisances, and care and feeding contracts. Mandated by the Iowa Code 654, these mediations start when the aggrieved party submits a comprehensive request to Iowa Mediation Service (IMS). This request should include relevant contact information and an outline of the dispute.
Upon receipt, a structured 42-day timeline begins. The first half, or 21 days, is set aside for the responding party to consider whether they wish to participate in mediation. If they consent, the next 21 days are dedicated to Iowa Mediation Service arranging a mediation session, setting up a conducive environment for constructive discussion and resolution. |
In the mediation process, the parties involved have the power to determine the final outcome. An experienced mediator assists by ensuring that every party understands each other clearly and helps them to evaluate their options. This procedure is confidential and considerably more cost-efficient than litigation.
In instances where an agreement cannot be reached, a release is provided. If, however, the parties successfully find a mutually agreeable solution, the mediator facilitates the creation of a formal agreement for all involved parties to endorse. Once this agreement is signed, it becomes legally enforceable for all participants.
